1. About these Terms
These Terms of Use (“Terms”) govern your use of pixidion.com (the “Site”). They cover the website itself — what you can do on it, what’s expected of you as a visitor, what’s reserved by Pixidion.
For the terms that govern a paid design engagement with Pixidion — scope, deliverables, payment, intellectual property, source files, promotional rights, cancellation — see Pixidion’s separate Service Terms.
Pixidion is the trading name (DBA) of Ivan Ortega, a sole proprietor operating from Las Vegas, Nevada, United States.

2. Acceptance of these Terms
By using the Site — including loading any page, submitting the contact form, or downloading any content — you agree to these Terms. If you don’t agree, don’t use the Site.
These Terms apply alongside Pixidion’s Privacy Policy and Cookie Policy, which govern how Pixidion handles your information.
3. What the Site is
pixidion.com is a marketing and lead-intake site for Pixidion, a solo graphic design studio based in Las Vegas, Nevada. The Site:
- Describes Pixidion’s services and pricing
- Hosts a portfolio of Pixidion’s work
- Provides a contact form for inquiries
- Hosts these legal documents (Privacy Policy, Cookie Policy, Terms of Use, Service Terms)
The Site is not a transactional platform. Quotes, invoices, and service delivery happen separately — through email, Square (invoicing), and the messaging channels listed in the Privacy Policy.
4. Acceptable use
When you use the Site, you agree to:
- Use it for personal or business purposes related to engaging with Pixidion, evaluating Pixidion’s services, or general information.
- Not attempt to access non-public areas of the Site, the underlying infrastructure (Netlify, Google Workspace, Square), or any other Pixidion system.
- Not probe, scan, or test the vulnerability of the Site or any associated system.
- Not interfere with the Site’s operation through denial-of-service attempts, overloading, or abusing the contact form or any other input.
- Not scrape, harvest, or systematically extract content from the Site without Pixidion’s prior written consent. Manual research, quoting, and linking with attribution is welcome; automated bulk extraction is not.
- Not introduce malicious code (viruses, worms, trojans, etc.) or attempt to inject content through forms or other inputs.
- Not impersonate Pixidion, another person, or another business when submitting the contact form or otherwise communicating with Pixidion.
- Not use the Site to harass others, including by abusing the contact form to relay unwanted communications via Pixidion.
- Not use the Site or its content in any way that violates applicable US, Nevada, or local law.
Pixidion reserves the right to block, throttle, or refuse access to anyone violating these terms.
5. Site content and intellectual property
All content on pixidion.com — text, images, logos, design, code, layout, the Pixidion wordmark and marks — is the intellectual property of Pixidion (or its licensors) and is protected by United States copyright and trademark law.
You may:
- View the Site in your browser for personal or business research.
- Share links to pages on the Site freely.
- Quote short text excerpts in commentary, reviews, or articles with attribution to Pixidion and a link back to the source page.
You may not:
- Reproduce, republish, or rehost Pixidion’s content (text, images, design) without prior written consent.
- Use Pixidion’s marks, logos, or wordmark in a way that implies endorsement, partnership, or affiliation that does not exist.
- Use any content from the Site in any product or service you sell or offer.
Portfolio work shown on the Site: Some portfolio pieces depict client work. Pixidion’s right to display these as portfolio is governed by the Service Terms. Underlying ownership of any specific client deliverable rests with the client per the Service Terms, subject to Pixidion’s reserved promotional rights detailed there.
6. Copyright complaints (DMCA notices)
Pixidion respects intellectual property rights and expects the same of its visitors. If you believe content on pixidion.com infringes your copyright, send a takedown notice under the Digital Millennium Copyright Act (DMCA) to Pixidion’s designated agent.
Send DMCA notices to:

- Mail: Pixidion · Ivan Ortega DBA, Attn: DMCA Agent — Las Vegas, NV (full mailing address provided on registration of the designated agent)
A valid DMCA takedown notice must include (per 17 U.S.C. § 512(c)(3)):
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material on pixidion.com claimed to be infringing, with enough specificity for Pixidion to locate it (URL or screenshot helps).
- The sender’s name, mailing address, telephone number, and email address.
- A statement that the sender has a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that the sender is the copyright owner or authorized to act on the owner’s behalf.
Notices missing any of these elements may be invalid. Knowingly false or inaccurate DMCA notices can expose the sender to liability for damages, costs, and attorney’s fees under 17 U.S.C. § 512(f).
Counter-notification. If content is removed in response to a DMCA notice and you believe it was removed in error, you may send a counter-notification meeting the requirements of 17 U.S.C. § 512(g)(3) to the same address above. If a valid counter-notification is received, the removed content may be restored in 10–14 business days unless the original notice-sender files suit.
Repeat infringers. Pixidion will, in appropriate circumstances, take steps to limit or terminate access for users determined to be repeat infringers, consistent with 17 U.S.C. § 512(i).
Designated Agent registration with the US Copyright Office is being finalized. Until that registration is on file, the contact above is the operative channel for DMCA notices.
7. Third-party links and resources
The Site may link to third-party sites — client websites, Behance, Awwwards, social platforms, blog references. Pixidion does not control those sites, does not endorse their content, and is not responsible for what you encounter there. Use third-party links at your own risk and review their own terms before relying on them.
8. Disclaimer of warranties
The Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied, except where prohibited by Nevada law. Pixidion makes no warranty that:
- The Site will be uninterrupted, error-free, or secure.
- Defects, if any, will be corrected.
- The content is accurate, current, or complete.
- The Site is free of viruses or harmful components.
Pixidion’s services described on the Site are subject to a separate engagement under the Service Terms. Nothing on this Site constitutes a binding offer, contract, or commitment to provide services. An engagement only begins when both parties electronically sign a quote, SOW, or Retainer Agreement and Pixidion receives the deposit (or first month’s payment, for retainers).
9. Limitation of liability
To the maximum extent permitted by Nevada law, Pixidion’s total liability arising from your use of pixidion.com or its content — whether in contract, tort, or any other legal theory — shall not exceed one hundred US dollars ($100). Pixidion is not liable for indirect, incidental, special, or consequential damages (lost profits, lost data, business interruption, etc.) arising from your use of the Site.
For liability arising from a paid engagement with Pixidion, the cap in the Service Terms governs — not this Site-use cap.
10. Indemnification
You agree to indemnify and hold Pixidion harmless from any claim arising from:
- Your breach of these Terms.
- Your misuse of the Site or its content.
- Your violation of any third-party right (intellectual property, privacy, contractual, etc.) through your use of the Site.
11. Modifications to the Site
Pixidion may modify, suspend, or discontinue any part of the Site at any time without notice. Pixidion is not liable for any consequence of such changes, including loss of access to any specific page, feature, or content.
12. Termination of access
Pixidion may, at its sole discretion, block or terminate your access to the Site at any time for any reason, including breach of these Terms. Termination of access does not waive any other right or remedy Pixidion may have under these Terms or applicable law.
13. Governing law and disputes
These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws principles. Any dispute arising from your use of the Site shall be resolved first by good-faith negotiation. If negotiation does not resolve the dispute within thirty (30) days, either party may propose non-binding mediation before a mutually agreed mediator in Clark County, Nevada (in person or by videoconference), with the mediator’s fees shared equally. Mediation is optional — it proceeds only if both parties agree, and neither proposing nor declining it limits or delays either party’s right to bring the dispute to court. Disputes not resolved by negotiation (or by mediation, where both parties elect it) shall be brought in the state or federal courts located in Clark County, Nevada. The prevailing party in any legal action is entitled to recover reasonable attorney’s fees.
14. Severability
If any provision of these Terms is held unenforceable by a court of competent jurisdiction, the remaining provisions remain in full effect.
15. Entire agreement
These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Pixidion regarding your use of pixidion.com, superseding any prior or contemporaneous understandings, written or oral.
For paid engagements, the Service Terms, together with any signed quote, SOW, or Retainer Agreement, form a separate and complete engagement agreement.
16. Assignment
You may not assign or transfer your rights or obligations under these Terms. Pixidion may assign these Terms to a successor entity, including the conversion of the sole proprietorship to a different business form (e.g., LLC formation).
17. Changes to these Terms
Pixidion may update these Terms from time to time. Material changes will be noted with an updated “Last updated” date at the top. Continued use of the Site after changes constitutes acceptance.
